Glad you are not part of the damage. As for the insurance, I had a mishap caused by another driver last month. I never even called my insurance company because I only have liability coverage.
I called his. Gave them the policy number, and the guy's name, and they opened a claim.
Sounds like your damage is more severe than mine, but they never sent out an adjuster, never asked for pictures. They just paid it off.
Different states have different insurance laws. I live in Massachusetts and the accident happened, and driver lived in New Hampshire.
Don't be timid. Insurance companies make their money by not paying claims.

Seems like Blue Book for my ride is 4400 and the shop is at 3600 for parts already, Insurance co did get in touch with me, polite so far. Sending the adjusters. Gonna go visit tomorrow.

But my understanding of how this works is that the other parties liability insurance should pay to make you whole. Not up to the blue book value, but up to what you had before some dumbass crashed into your parked bike. That is what the liability insurance part of anyone's policy is all about.
You shouldn't have to lose because of someone else.
If you get anything besides full repair or replacement, hire a lawyer, and add their cost to your claim.

Exactly. Those accident attorneys do more than "if you're hurt" stuff, they should be able to help with this kind of stuff too.

If they total it,You should at least wait until they give you a no.#, Look for for bikes that are similar to yours (options, age and condition) that are for sale in your area and see if the Ins. co. price is amendable to this. Don't forget the sales tax , registration and inspection fees needed to get back on the road!!

Sorry about your bike Warren and glad you weren't on it. From the parts price so far, the adjuster will probably declare the bike a total loss. As has been said, take no prisoners with the insurance company. The adjusters job is to settle for the least possible. Include the costs mentioned earlier plus your expenses to shop for and acquire another bike. Tell the adjuster that you will need a rental bike (whether you do or not) until they settle. They hate to pay rentals and will settle quicker if it is going to cost them more. Also, when they total it, you may want to ask how much they will sell you the salvage for. Often, they will sell the salvage to the owner for small $$$ so they don't have to sell to a salvage yard. If you get another America, you will have a parts bike to use, sell or you can fix it yourself with parts here or from fleabay. If you buy it back, be sure to find out how much the dealer is going to charge for storage ($20-$50 per day) and who's going to pay. If it is you, subtract that from your offer for the salvage. If you aren't interested in the salvage to keep for yourself, let me know.

The other car's owner is liable for your damages. Tell them that you just took a deposit for an agreed upon price of $5900 from the bikes new owner and were heading to finish the transaction after work, (until THEIR car hit it). That's your damages. In MA you'd have a check on it's way, VA, I don't know. Good luck I hope you get every penny.

Even taking the $3650 offered by the insurance you should be able to break even after selling off the parts you don't want as well as the stock parts that come with it.

hope the lawyer has better info. like some sort of suffering loss due to the BS. OH was your helmet hanging on the bike? They have to pay for that also. shoot a good showie runns around 700 +/- ,, so there is a few more possible dollars. you might not have been on the bike but they ruined a helmet. Just a thought.

I would be happy with 4400, Not happy with 3650, they need to come up a bit. I'd be happy with somewhere in between, 3650 is too low.

NADA for my Texas zip gives it a 3510 average retail. Without bodily injury involved no lawyer will take it.
If it will bring 1300 in salvage per their appraisal then it is not totaled. Tell them to fix it. They are only at 65% to value. They owe you 500 more and make sure they pay for all the hauling and storage on it. They also owe you the pro-rated taxes and registration for the remainder of its license year.

In Virginia, the minimum liability coverage is $20.000 for property damage. Because your vehicle was parked legally, the claim lies at the feet of the other driver's insurance company
You do not have to accept their offer. I believe they can require you to get several quotes for repair, but they must pay for the lowest one that restores the vehicle to its original (pre crash condition). If you were claiming on your own collision or comprehensive policy it would be one thing.
But because you are filing a claim against the other party's policy, that is different.
In addition to adjusters being rated by their supervisors on how little they can settle for, they are also rated on quickly they can close claims.

Ordered parts to get back on the road. 3510 for my 2004 was too low, 1298 salvage value, hmmm, Garage has been empty too long, next time, I want a rental bike too!
