Rode the America to Cartersville yesterday morning to see my Mom....bless her heart, she suffers from Alzheimers and dimensia, so had no clue about the giant cherries on my elbows. That America rides like a souped up Cadillac compared to the T120....All apprehension gone now, looking forward to a 3 day work week, then off to the "British in the Blue Ridge" rally in Hiawassee possibly Thursday night....definintly Friday morning....

That's pretty cold Hitchcock. He was just looking for some support after wrecking his bike. No one knows how they would handle a situation unless your involved in it. From what I've seen, Mark has very good riding skills.

Yep, I agree.
Ya see Hitch, Darwin Awards are usually given out to those who do really stupid things after some comtemptation(kinda like when somebody says, "Here! Hold my beer and watch THIS!"), BUT Mark here had to make an instantaneous decision after the sudden and unexpected loss of power to his bike, as all things considered, I don't think his decision was wrong. Nope, it was that cagers who made the wrong decision.
And so, I gotta say, you're more than a little off the mark in Mark's case HERE.......anyway!!!

I admire the compassion for a guy who raises his right arm, moves to the right as if to pull over, then turns to the left in front of a moving vehicle. If I offended any with the jibe, then to them I apologize.
Perhaps Mark & I got off to a bad start after he killed his dog by locking it in an enclosed vehicle in the GA sun. I guess I never quite got over that one.

After already posted my liability assessment. Some insurance company will probably pay something to make it go away. As for right and wrong?
I think a Darwin award is a bit harsh. But, the title of the post is advice not sympathy. Everybody feels bad when one of us goes down.
With his actions I would have thought he is stopping on the right as his throttle hand is up like a "time out" I am stopping here. I would have gone around him.
I would have felt badly if I hit him as he swung into the path of my car. Would not have felt so good when he hired a lawyer to prove I did something wrong to collect money though.
I guess the guy in the cage deserves a 20% increase on all of his insurance for the next 3 years because of this mishap. I am sure his family won't miss that money.
My advice, drop any action and accept you were a big part of this confusion and mishap. As I read the description nobody got "rear ended" here. Somebody did a confusing lane change and got hit.
The real wrong here is a system with a lawyer and a lazy insurance company that will spend money and collect money out of convenience then raise the cage driver's rates.
I try to aggravate one person a day. Today may be your day.

I understand the judgements passed with regard to my Darwin statement, but what is not readily evident to many is that the frame of reference extends to a lengthy list of events, including first person witness, dating back to 2006.
So this doesn't turn into a soap opera for the mods to mop up, I will make this my last post on the topic. If it's about who is right or wrong, I'll take the wrong label and move on.

Well Jim, I THINK I have an old single-leading shoe one o' those off an old Bultaco sittin' around in my garage somewhere...though I kinda doubt it'll fit on Mark's old Bonneville!!!

Well, trust me here, Jim. He really DOESN'T want that old Bultaco brake o' mine. When I first purchased that Street Tracker years ago, that little thing was on it, and it didn't stop that bike worth a damn!!!
(...and that's why after a couple of years I had Buchanan's re-lace a Honda Super Hawk TWIN-leading shoe to the Akront rim on that baby)

Why a Honda twin leading shoe and not a Triumph twin leading shoe front hub?
I have a couple Suzuki twin leading shoe wheels floating around still along with a few Triumph ones still.

Because the Akront rim originally on the bike was a 36-spoke number that was laced to that little Bultaco 36-spoke break...err...BRAKE! And so, because I wanted to use that rim and not have to purchase another one, and as you probably know, all old Triumphs used 40-spoke rim/brake/hub units, I went with the Honda Super Hawk brake which had a 36-spoke arrangement.

Alright, decision has been made by the PROGRESSIVE GODS...we both had progressive insurance, and after a brief debate among the managers, they came to the conclusion that I was at fault for not properly signalling my intentions....They will pay nothing toward my bike or injuries. Lawyer backed out as well, as there's not enough "interest" to his firm. Georgia law requires turn indicators for any machine manufactured AFTER 01 January 1972...My bike was built in March of 1972 of coarse. Damage list: Both throttle cables (Twin Amals), front brake cable, Speedometer, Tachometer, right tank badge, re-paint/bondo tank, front fender, tail light lens, and right handlebar grip. Engineering friend coming to inspect frame for damage, but none visible...$500 or so should get her better than before....Oh, and I agree, I MOST CERTAINLY DO qualify for the Darwin award!!! I went to drain gas from tank for painting, and was'nt a drop in it!!!! All caused by simply running out of gas apparently....So your right. As far as the dog, I still have'nt quite got over that yet either, but we are all human, and make mistakes....Perhaps Im a little MORE human than the rest of us!!!  Here's my Bonny just before leaving for Blowing Rock, NC..May of 2012...942 miles and one crash all together!

Yeah, I was kinda thinkin' the same thing here, Ed. So Mark, were they sayin' that because you didn't use those and used hand-signals(well, at least YOUR version of 'em anyway ) instead, that THAT'S the reason they're bein' the way they are here??? I always thought hand-signals were an acceptable alternative to usin' the blinkers...though I do realize there are variations in the law from state to state about this.

Here in PA hand signals are acceptable but they would still have to be the correct signals or the point is mute.

This is a classic example of what happens when both parties have the same insurance company.
Farmers Ins tried to do the same to me when I had a fender bender in my car. The other driver in my accident got a ticket and Farmers still tried to weasel out of paying.Had to appeal it to get my payout.

Oh, I neglected to share with you guys that this picture was taken BEFORE crash number one that took place just off the Blue Ridge parkway the day AFTER this pic was taken...Im sure I'll qualify for the Darwin award for that crash too!

Here's the accident scene just off the Blue Ridge Parkway....centerstand caught in a sharp left turn, pivotted the bike off the ground, and over we went....It was fun, and neither I nor the bike was injured....Notice the Darwinian nincompoop standing in the middle of the road awaiting further tragedy!!!!  I left my marks off the BRP! (I smell a song)  HERE'S what happened to my turn signals...  Take that cursed centerstand off!!!! My partner says, so I did...  The "DPO" sign on the back stands for "Dreaded Previous Owner"!!! How fitting!!!!
