Yes he can ask to do whatever he wants. Like for instance, "You mind if I search your car?"... answer "NO". You know you can say that right? You know, you're not breaking any laws by saying NO. The cousin of the original story was innocent, but he still got carted off to jail for no reason. I'm just saying, it could have been handled better by the kids to prevent that from happening. I understand, they're young and scared, I've been there too, and I hate that feeling.
