Wow... lots of firsts lately. I was pulling up to an intersection...hand on the brake... and the car in the lane to my right decided (very suddenly) that he needed to be in my lane. I tried to swerve to avoid him, but was already braking, so I went down like a ton of bricks. Good thing it was low speed!
Damage to me: sore hip flexor, sore shoulder, skinned knee.
Damage to the bike: scuffed mirror and clutch lever, broken turn signal, bent/scuffed engine-dress bar, bent shifter, scuffed center-stand and side stand tang... I was lucky that the center stand and engine bar took the brunt. She peed a little oil when she went down, but not since... I'll bring her in for a once-over asap.
The driver was a 17 year old kid... His first accident and he was scared witless. I got his insurance info, but since he didn't actually hit me, I'm pretty sure he won't be held responsible.
Lesson learned: ALWAYS SEPARATE SWERVING FROM BRAKING!!

Shoulda called the cops sir. Lane switching at an intersection is illegal when the solid white line is present. Even if he didn't hit you, you did everything you could to avoid the accident. Right now it's your word against his, and I would say he did bump you causing you to go down. Either way though it was his fault, he should have been ticketed with a lane violation, and you should get all damages repaired.

Without an accident report, I doubt you will be able to get anything from the kids insurance company. You might still be able to file one though, as lots of places now allow you to call in the accident and they will send you the report in the mail.

I am a claims adjuster. I have been handling auto accident claims for over 30 years all over the USA. I am pretty sure he will be held accountable. He violated your right of way. Contact or no contact. You can call me- Larry Gregory 678-574-0204

Actually, here in OR, you don't need an accident report. The cops don't even want you to file one unless there is an injury.
Yeah, center stand. I got one from newspeedmaster.com when I first got the bike. Big sturdy chunk of metal that probably saved my left-side pipe.

That is correct only if he admits to the behavior to his carrier. No contact accidents would require an independent witness or admission. Remember, with no damage to his car there is no physical evidence to investigate.
If the kid lies they get paid a premium to believe their insured. I would surely make a claim against him.
I try to aggravate one person a day. Today may be your day.
