I know this has come up and no one ever really knew the answer so here it is ! If you have a 08' bike with the new style tank you can install the old style( it bolts right up. The fuel injection is the only model that will cause problems. My bike is an 08' with carbs and I bolted the old style on just fine. If you look under the tank of a 08' there is lots of space on each side for the following year fuel injection but the 08 is still unchanged. 
If it isn't broke ...break it ! then you'll have something to do !

That has me thinking. I like the idea of 5.1 gallon tank on my '05 America. The 4.1 looks better, however it just isn't big enough.
Didn't buy into the hype, you can keep the change.

Yes the 08 for the US market still has carbs. The 09 is injected. We are a model year behind the UK for that type of change. ( hope I got my years right)
