It's not unusual for LEO to withhold charges in the aftermath of a fatality, pending reconstruction of the timeline prior to the incident, etc.
In addition to local LEO, whenever there is a fatality involving a semi, the NTSB will participate in the investigation at the federal level.
The truck driver is not out of the woods by any means.
