Well back in June, driving home from applebees after having 2 long islands made a right turn and swung too wide striking the vehicle in the other lane. It was raining very hard making it hard to see the yellow lines. Anyways, I approached the guy in his truck seeing if he's ok. I admitted all fault, and gave him my information. He said well the cops are on their way. I said well give him your side I've already admitted fault, I'm going home. You've got my info. I go home. 15 minutes later I get a phonecall on my cell which is the officer reporting. "Sir, you have 1 minute to get back to the scene of the crime." I said well I'm not driving my truck anywhere, and I've already done what every other fender bender does. He said you've got 1 minute and hung up. I started walking (it was only 4 blocks away.)
Long story short the guy I gave info to lied and said I gave him nothing and fled the scene. So I got a DWI (#2), fleeing the scene of an accident, and a CNI (Careless negligent imprudent driving). All for walking back to the scene cuz I fled anyways? I didn't blow because my lawyer said for your second you're going to loose your license for a year anyways, its easier to get out of it if they have no evidence. I WAS WALKING ANYWAYS.
Anywho I've got court this week on tuesday and thursday. tuesday means I lose my license for 90 days for refusing then I get a hardship for the other 9 months. Thursday I get 2 years probation, 40 hrs of community service, and 6 months of ignition interlock installed on all my vehicles.
So do you think they're going to install the ignition interlock on my TBA as well as my truck? Or would it be if I get caught on my bike which wasn't interlock installed I get nailed?
All in all though I'm planning on removing my airbox anyways, so I prolly won't be riding it this winter. Also, I'm lucky to be living with my lawyer's daughter which yes we are dating pretty seriously, so the lawyer's fees from what I can tell right now are FREE. Only stipulation is that I don't break up with her cuz he'd have me by the who-haas.

Advice we give our clients - (1) Stay sober; (2) get a 49cc scooter, and (3) a full-face helmet. Sorry about your troubles, hope everything comes out, okay.

Since I gave him my insurance card, and couldn't provide one for them, the officer almost gave me a no proof of insurance on top of it. He said he'd let that one slide for the other three. Even when I stated that the other driver has it, and I have his at home.

Thats all what I'm still trying to figure out. He had my ID pulled up on his laptop when he put me in the back. I don't know if they keep info like that from previous arrests, cuz thats the only way other than from the guy I hit.
Thing is I've got the other guy's information (DAVID ZAK). I'm going to say I'm not really happy with the way he handled all this with the lies. Its been pretty hard for me not to ride up to his doorstep and give him a word or two about it. I won't though cuz its just more trouble for me. What a ******.

Did this guy ever say that he WAS going to contact the police before you decided to leave? Because, if I had nothing to "hide" I certainly would have stuck around to explain how the rain caused me to "be at fault"(congrats BTW for at least dong THAT rarity in today's world) when the cop arrived!
Of COURSE the "natural assumption" almost anybody would have towards someone with whom they hadn't reached some sort of agreement(other than an minimum required exchange of info) before that other person decided to leave the scene of the accident, would make that other person in their eyes(even it they didn't sense overtly that the other person might have been impaired in some manner) a little suspicious also.
(YEP!!! I'm a reeeeallll friggin' "Glitch"..or worse...ain't I???!!!...but THAT might be because I've had friends, co-workers, AND relatives killed and/or injured by people who "don't have a problem" but somehow have received MORE than one DUI infraction over the years?!!!!...but THAT was probably THEIR problem, just like MY little "intolerance problem" here, HUH???!!!)

1. What are you, stupid? Twice? I can see once - sometimes you're not sure if you're over the line, you get unlucky and get caught. Heck, I've driven over the line once and was glad I didn't get caught. It freaked me out so much I didn't want to experience that much paranoia again. But twice? No sympathy from me. Just glad you didn't kill someone. 2. Why would you air this out here?

why the ****** did you leave the scene? You said the guy told you the cops are on their way. I'd bet a good amount that if you stuck around, none of this would have happened and it'd be up to the insurance companies to straighten everything out.

Even if you had damaged an unattended vehicle, you still have to notify the nearest LEO station, how do they put it? without unnecessary delay?

Looks like we got ourselves a bunch of saints here who have never done anything wrong or stupid. He obviously left the scene because he was drunk. Whenever anyone gets pulled over they always say "I only had 2 drinks." That one I'm not buying. I've never had a dui but can think of many times when I was well over the limit. Come down off your high horses and give the guy a break.

people who drink long island ice tea are drinking for the effect..not because they are thirsty or like the flavor.Learn the lesson and move on.Drinking and driving anything leads to problems..you have the solution to your problem...community service,blow machine..AA works..it really does!!  three things can happen...you get sobered up,you get locked up,you get covered up.The first two happened to me!!

Yep, I've been too wasted to drive and have driven anyway in my past, and possibly my future, but not in my present. Still no sympathy from me, and I wouldn't expect any had it BEEN me. BUT... I wouldn't have posted this one on BA.com, either. (I just post the stupid crap I do like running out of gas and not taking care of my generator.)

Absolutely no sympathy for DWI. Lost too many friends that way. Maybe the judge will do you a favor and insist you attend a couple dozen Mothers Against Drunk Drivers (MADD) meetings. Then you can meet a few of those folks with the "My son/daughter was killed by a drunk driver" stickers on their car! Coupled with a few weekends working at the County Morgue, will probably be the best education you'll receive.

You left the scene of an accident.
No matter the result of your case, you have one thing to remember, forever:
ONE DRINK PARKS YOU FOR THE DAY. NO EXCEPTIONS.
There are too many reasons why to list.
It would have been better for you to have taken the breathalizer.
After all, you could have gone home and taken a drink to "Settle your nerves", reasonable doubt.
But, since you refused, you're SOL.
Take your punishment and learn.
And don't do it again.

how old are you??? and is this why i get so many bad thermostats from honeywell??? drinking and driveing, these days, aint cheap!!!! driveing is a priveledge not a right and i ride a motorcycle and i dont want you diveing your truck up my butt when i am trying to get it home in a rainstorm!!!! what if that had been a biker and you had killed him or worse yet just busted him up so bad his life would never be the same???? i think these days you will be hard pressed to find sympathy from thinking people

I understand guys I was ignorant, and I need you guys to tell me how stupid I am. Its time I switch support groups and become more mature, and recognize. I know it was stupid to leave the scene, and yes I was drunk. I also didn't mention that a second dui has a bad impact on my job. I have a 40% chance of keeping my job right now due to this. I was under a lot of pressure, and I didn't do the right thing. P.S. I'm only 23, and no I don't make "thermostats, brake pads, or oil filters." Here is where I work: www.kcp.com

I guess that means I'd hardly ever be riding. I guess it's different for everyone, but I don't see a problem with having a beer and riding. I may drink more than most of the people on this forum, but I have strict rules (for myself) when bike riding - no more than one beer per hour to stay below the limit. A day doesn't go by when I don't have at least a couple of beers. I'm glad the laws where I ride aren't as strict as you are. I've never had a DUI.
I guess I should add that my only bike accident was the other guy's fault and I had not had anything to drink. I've had a few car accidents, a couple my fault, but none had any drinking involved. Five years ago my wife and I were sitting at a red light (in our Jeep) and a guy hit us going over 60 mph. He had been drinking and was getting a BJ at the time. No, nothing got severed. My neck is still screwed up and will never be right. The guy was over the limit and only got charged with a misdemeanor. That does bug me.
You should have stayed and talked with the police. There's a chance you might have avoided a DUI by being cooperative as well as present. Attitude has a lot to do with the police reaction you have to deal with.

I'm guessing you don't remember the president of MADD getting a DUI 2 years ago do you. Bunch of hypocrites.
Ignition interlock on all vehicles means you have a breathalizer in you car that you have to pass with nothing on your breath before you can start your vehicle. Long trips require a retake every 30 minutes.

23! The ignorance of youth.  At 23, I did things 100 times worse, probably 100 times more then you've done so far. Didn't permanently maim or kill anyone, but just due to being lucky. You probably won't respect life untill you've had and raised a family. No one can live a normal life after they've lost a loved one, due to the improper actions of others. But you will hopefully find out before something tragic happens due to your actions. Probably over 50% of us have done worse then this, but were just trying to get you, or any youth, to learn from our experiences. Yes, ignorance, arrogance, attitude, thats what being 23 is all about. I support you, hope you learn faster then most, and hope it doesn't happen again, and if it does, just pray the results are no worse then this time Good luck and God bless.

Okay, now it's time to look on the bright side. You didn't kill anyone, least of all yourself. You didn't even injure anyone. It's just a little property damage. Personally I don't care as much about leaving the scene of an accident as much as the decision to drive even slightly intoxicated. It's a lapse in judgment, although repeated. So ya take your lumps and you move on. Just promise never to do it again.

Here the bad part I just had to fire two of my employees/friends because they got DUIs
So lets do the list
They got fired
They got to spend 10 days locked up on the state
They get to pay more insurance
They get to look for new jobs in the worse economy in years

Trust me guys I'm not trying to beat the system. I didn't. It won. Yes I'm very happy I didn't kill anybody, or injure any person who is inocent. Yes, I'm in a serious predicament, and yes I need to desperately change my ways. I've attended 11 AA meetings in my area, and if anyone has attended one of these, I can't get past step one. Step one: "Admit it YOU are powerless over alcohol." I quit drinking for 3 weeks, i'm not an alcoholic. Yes three weeks may sound like nothin to non drinkers, but I have moderated big time. I only drink when I am at home, and do not need to drive anywhere. That, I think, is my step one. We can sit and think about could've's here, but things didn't happen and everything happens for a reason. My reason is I really need to stop drinking and driving and take it much seriously.
I'm sorry to anyone who has been a victim to such a shameful act. Whether its family or personal, I'm sorry.
I'm lucky nothing serious has happened from my drinking and driving.

Hey dude, I am not sure if I should chime in here or not. I lost my brother in 97 due to a drunk driver, he was riding to work over in De-soto Kansas, his luck decided to ride his bike that night instead of driving. Well was hit from behind by a guy who had just left the bar, he lived long enough to be put on life flight and died in route to the hospital.
Now I will say when I was younger, yes I drank and drove alot, way more then I ever should have.
After seeing what it does and living it myself, I quit completely for along time. Now I may have one or two in a year. Lose someone close and really makes you think about it.
If you need support, I am sure there are plenty of us on here who live close enough to give you a hand. Isnt that what a biker brotherhood is all about. Not to just gripe at you, but to offer support when you need it. Really think next time your out, do you really need that drink, believe me, just as fun to stay sober. The point is not how many drinks you can handle.
The point is when 'ol LEO asks that question, "Sir, have you been drinking tonight?", the answer is no.
Even if your BAL is under the legal limit, the arresting officer can testify that you seemed to be impaired.
I had a DUI in 2000, several of the people in my mandatory DUI counseling class were under the limit (one at .06) and still found guilty.
The "One drink parks you" rule is the only way I can be sure it will never happen again.
But hey, roll your own dice.

Weeeell...TRUST ME...."rollin' them there dice" in this world is a DARN SITE EASIER if you'd FIRST take a good hard CRITICAL LOOK at yourself. And NOT just for the reason to "beat yourself up" about this, BUT TO gain the understanding that...YES...I'm sorry to say...YOU DO use ALL the classic excuses an ALCOHOLIC uses to rationalize their behavior.
BUT, there IS HOPE!(yeah, yeah, yeah...I KNOW you think that's only a cliche...but dude...IT'S NOT!!! For I have known and ADMIRED many, many, many Alcoholics in my life who NO LONGER are DRUNKS!!!
YEP! I RESPECT them TRE-friggin'-MENDOUSLY for their ability to not only "change" their behavior, but ALSO for their ability to look at themselves CRITICALLY, which at your young age I'm sure you have NO friggin' idea how RARE and SPECIAL a quality that is in a man!!!
