Well that's where you are wrong. The 2nd Amendment just gives me the right to bear. State laws are also in play. The Florida concealed weapons (CW) law for instance, does NOT give anyone an excuse. That law is VERY specific when and where one may use a firearm. There is nothing capricious about it. However, that law also give me the right to protect me and my loved ones from cretins who have no respect for life itself and btw, those people are everywhere.
