Tonight 3 girls showed up at my house and assaulter Wendy and Amanda our 20 yr old daughter and pregnant. They kicked her in the stomach because she is pregnant. One girl had Wendy on the ground and punching her in the face. I pulled that girl off and the fight stopped when I went outside. They had been asked to leave before the fight started. The problem was our other daughter is dating the one girls X boyfriend. Well after all this and they even admitted what they did the cops didn't arrest them!! Can you guys believe that?!?! They say if they come back or call on the phone then they can charge them with jail time offences. But they are only 17 so they get a slap.

its called lazy cops.. Why arrest 3 people when you can hang out and play halo3 on your county supplied computer

I was tempted but they weren't armed. You can only use like force. Wendy goes tomorrow to the station to have pictures taken of her injuries and then they may be arrested for simple assault if Amanda has a miscarrage it may be murder or manslaughter possibly.

That's a bunch of crap! They should have hauled them in, especially if you guys said you would press charges.

Trouble is the parents are as bad or worse! We couldn't hit them back because they are minors,trust me ,we wanted to but are smarter than that. If we had hit them we would have been the ones in jail.

We not only agreed to press charges but were trying to get the cops to charge them with something. The way they talked we have to wait for it to escilate before they can do anything.

How about "criminal trespassing". A misdemeanor in most places, but it's a starting point.

Get a restraining order. That way there'll be additional charges (maybe felony) if they violate it.

It isn't criminal trespass unless they come back from what the cops said. The restraining order is a good idea Bill.

Wendy wants me to make sure you guys know she didn't fight back because they were minors but wanted to. She says she feels like such a wimp because she had to take it.

This is harsh and even more so that there was not much you could do at the time. I hope that you do find someway to hit them with the law as they are bound to go on to much greater things if they are left unchecked at this time.

Seems Oregon has some messed up laws. It doesn't matter what their age is, once they attack you, you are allowed to defend yourself with physical force. I understand not pulling a hogleg during a fistfight, but striking back in self-defense is surely permissable under Oregon law. Those cops were WRONG in what they told you. Contact the District Attorney's office, or at least a law enforcement office above the level of those POS cops that responded, and ask them. There is a tad bit of "Cops too freakin lazy to do their jobs" going on there. And YES, you have a right to persue this as they are public servants and YOUR taxes pay their wages. They need to actually earn those wages.

I'll bet you $5.00 one of those cops KNOWS one one the girls or her parents......

Kudos for showing restraint in a tough situation. I don't understand attacking a pregnant woman as not being attempted homicide though. Seems like one kick would be enough to warrant arrest, minors or not. Maybe you should contact the local DA and inquire about PA statutes. Press whatever charges you can and be certain to post a No Trespassing sign so you can charge that if they unwisely return; coupled with a restraining order that can force the cops hands. Me, I'd call the parents and put them on notice any more contact from their children will be grounds for litigation. Again, kudos for staying cool in a dicey situation especially considering the stresses you've been under lately.

The right way for PA. would be to go to the District Attorney. Make a complaint against the girls for assault and a complaint against the police for their failure to act.

The best way is to take somebody with a video camera to the police department. Keep filming while you complain and want to know why they failed to arrest those who assaulted your pregnant daughter. Tell them you need a person in authority now. When they tell you to leave say "Again you are failing or refusing to help us in this felony assault." "Why is that" Force them to threaten you with arrest. Tell them you will be back with the press the next day. As a matter of fact take about 4 cameras and have some mention youtube while filming.

Still think the cops know the kids or their parents and are sloughing off their responsibilities as Law Enforcement Officers.

Dog, I would call the shift supervisor at the station or precint and work your way up that way as well. I'm no lawyer but assault or battery doesn't only count when it's the second time I believe, or only when performed in the presence of LEO's.

Ian- I'm thinking, report the attack to your state's Child Protective Service (Dept of Youth Services, Dept of Social Services?), whatever that would be. The girls involved in the attack may be "in the system" in some way- or clearly need to be, so you might be able to have some charges/consequences pressed through the juvenile system?

The restraining order is the thing to do no matter what. Get a copy of the police report which would indicate names, DOBs, etc. for your restraining order and for the report to the juvenile system.

I'm pretty sure in Montana you have the right to defend your property and loved ones with deadly force.

I love this state.

Of course, it will only take one law suit to change all that.

Some very good ideas there thank you all. So far we are being told as soon as Wendy opened the door and asked them to leave she was challenging them to a fight by simply opening the door. She called the supervisor this morning, for assault she has to go to the ER and be checked out, documented , and fill out some paper then maybe they will do something. The Sgt. said he has 4 more similar situations to deal with today. They are now threatening to kill Nicky (our 14 yr. old) at tonights football game. She is a varsity cheerleader so we notified the coach and are working on evidence such as threats on my space and phone calls to take to the state police. In my area , and some others not sure how many, if you report threats and call the phone co. you can hit *57 and it notes the call at the phone co with the number, blocked or not, and also sends the info right to the police.This isn't the way I would have handles this a few years ago and much less satisfying but the right way I think.

I would like you guys to know we are using many of the ideas posted here.Wendy is on the phone with Children and Youth right now,we will be going to the DA to file charges, we are going to the ER with Wendy to documant her injuries and then back to the police station to push for assault charges. We contacted the state police and they basicly told us the local cops are not doing their jobs and those girls should have been taken away in cuffs and had the parents called to pick them up at the station after being charged. It does appear we may have recourse but that has yet to be determined and I'll keep you all updated. Special thanks to 03cruiser for taking the time to look up the laws for us. Thanx also for all the good suggestions and support like I said before this is a great group of people and have been nothing but good to me when I was down. Feels like an extended family.

I hope you get somewhere with Dept of Youth and Children....it is their mandate to keep children safe and to deal with problem youth. Keep the fire lit under them. I've been a mandated reporter of abuse and neglect in several of my jobs....I've found that it often works to start off any conversation with people (including the police) who I want to hold accountable, with - "Please spell me your name so I have it correctly for my documentation of this conversation"...Second statement is then "And please spell for me the name of your supervisor as well?".

I have just gotten back to the computer after a couple days. Ian, as has been previously stated, you are a much better man than me. I cannot kid anyone to say I would have acted as maturely as you have. I am very glad to see that you are pursuing the despicable actions of those cops. Unfortunately, holding those kids' parents accountable will be a waste of time, if they were any kind of parents, this wouldn't have happened in the first place. And I submit that there in lies the problem. Our society today has for the most part fallen into a world of touchy feely I want everything handed to me and will cry if I don't get my way. Guess what. we elected the pansy a$$ politicians who gave into the liberals.
