I think you are being way to generous! Reporting him to e-bay should be your first step.. the only consequence is that e-bay will send them a message reminding them that they are required to honor the auction terms, and will keep a record of his non-compliance. If he tries to pull the same thing repeatedly (like 5 times IIRC), they will boot him off e-bay. Usually, just the message from e-bay directly will cause them to change their mind.
