There is no law in NM one way or the other. Fortunately, there is never enough traffic around here to test the waters.
In CA, the semi official guidelines are don't exceed 30 MPH or exceed traffic speed by more than 15 MPH and don't do it at all unless traffic is moving less than 30 MPH. The reason lane splitting is tolerated is that it causes less problems than bikes sitting in the middle of the freeway with the engines seized from overheating.
