How come it seems that when somebody gets killed by a drunk driver - its usually not their first offense? I think we need to hit first time offenders alot harder! Maybe they won't become multiple offenders. Maybe I'm over simplifying things?
I think it's because the way our criminal justus system works, like most civilized counrty's we feel anyone can make a mistake and first offeneders are givin the benifit of a dought.Trouble is the fisrt time they get caought drunk driving probably isnt the first time the drove drunk. So for that reason fisrt offence should be tough but reasonable, say a years suspention and a heavy fine........second offence should be decapitation.

Doesn't matter how hard they get hit. The root cause of drunk driving is the moron who did the driving. They don't care about life itself so why on earth do they care about the penalty.
Alcoholism is an ailment, drunk driving is an intentional act that has no relationship to the disease.

In Oklahoma if you hurt or kill someone while DUI the police can have your blood taken even if you don't give your consent. I believe that it is the same in FL......Angelis
I wasn't gonna get in on this, but its late friday night,I'm tired, have had my 2 snorts after getting home from dinner, and...... Its the same in Arizona, you refuse to give a test as requested, on any DUI, even if noone is hurt, the officers can and do get a warrant - takes just about 20 minutes, however long it take the officer to fill out the check list warrant and fax it to a judge and get it faxed back, and he's taking your blood whether you agree or not. I just convicted my second felony DUI in 2 weeks (2 trials) - luckily neither involved accidents. My next two trials set are accident cases, but only minor injuries luckily. Send Billy here, I'd love to try his a@@ and send him to prison, not just jail!!! I sent some poor lady to prison for a year (absolutely no prior record) whose rear seat passenger was ejected during a single vehicle accident - she was on meth and marijuana at the time. And she got off very light! In AZ if you license is suspended & you are DUI its a felony; the first time you are convicted of that felony DUI, its a minimum 4 months prison as a term of probation. I'm working on sending a guy away for 8-15 years for his 9th - yes count them - 9th felony DUI!!! I wish I could send him for more!!!!
Anyway, I'll get off my soapbox now, and go to bed. Becky

Ya know...I'm surprised nobody's thought o' THIS solution to the dunderheads who can't seem to learn to control their intake of alcohol and are THEN caught DRIVING themselves somewhere.....
After their FIRST OFFENSE(and subsequent conviction), these "problem children" will ONLY hold a license to operate A MOTORCYCLE, for a period of time to be prescribed by the attending judge!(a minimum of 3 years should work, I'd say)
Ya see....THEN these particular....as I said, "problem children" would soon find out what it's like to be a friggin' TARGET out there on the road.
AND...this also has the added benefit that if these....as I said, "problem children" SHOULD revert back to form and then drink and drive while riding said motorcycle, the chances that they'll kill ONLY THEMSELVES is almost assured.
Because, as we all should know by now, one can kill a hell of a lot more people while driving some two ton SUV/truck/automobile while intoxicated, than they surely can while riding a motorcycle, YA KNOW!(this is the first rule of PHYSICS)
Cheers,
Dwight
(oh...BTW...If they ARE caught driving a car during their sentence, the judge would have the right to send 'em to GITMO, and their shinny new facilty down there....'cuz these "problem children" ARE some of the REAL TERRORIST in our society!!!)

Who is Billy Lane? what's he do?. sounds like he's a celebrity over there in the States. You don't have to be a celebrity over here in Australia to get a slap on the wrist and sent home after killing innocent people on the road, it happens all the time, it's a bloody shambles our legal system, A drunk driver driving on a suspended liscense for drink driving previously runs off the road and kills 2 pedrestrians walking on a footpath and gets off scott free & the ****** smiles on his way out of court. And on the other hand a bloke that owes the Govt. a few dollars in taxes gets 15 mths. - just don't make sense to me Hoffo

Unfortunalty Ray loss of licence dosnt garrentee they wont drive again, A woman not far from here ran over and killed a postal letter carrier couple years ago. Lost licence for life. 2 months ago she was arrested again for DUI.
Now a single .45 cal round to the back of the skull would pretty much keep him off the road forever,(if convicted of course) but we are too civilized for that.

You got that right.
What i find so frustrating. Why does it take so long to get these guys into court. This happened nearly a year ago. And its a cut and dry case. He was drunk while driving his pick up truck and he ran head on into a guy and killed him. Whats the point in a trial. Its a done deal. Strip him of his wealth and lock him up for 10 years.
Instead he will probably get a slap on the wrist, a small fine and then get a movie deal out of it.

His hubless rear wheel is what got his name out there. It's a really slick design. Sad somebody with that kind of potential tosses it all away. Sadder still that he tossed somebody elses life away in the process.

Well, speaking of "potential", Nathen....I'd trade a thousand Billy Lanes for just one John Britten. Now THERE was a guy with limitless potential who that darn "Big C"(cancer) took from the motorcycling world at the tender age of only 45!

Yes you are missing something. Seems like the Judge in this case has had issues with performing her duties in the past. INQUIRY CONCERNING A JUDGE, NOS. 03-47; 03-57 & 03-215 RE: MERYL L. ALLAWAS June 30, 2005 Happy reading.
Mr. Lane had a Blood alcohol level of .19. Florida's threshold is .08. Now do the math.
One Judge who can't seem to find the time to issue rulings, a blood alcohol level more than double the legal limit, one wasted Billy Lane passing on a double yellow line in his truck and runs head-on into a guy. That adds up to one rich attorney, society being screwed again, and one dead Gerald Morelock, R.I.P..
grrrrrr. At least the OCC boys don't drink and drive.

Yes. He is most definitely NOT a super star. William David Lane refuses to pay the hospital $8,422 that he received services from because of the accident he caused and the hospital had to file a lien against him because he won't pay his bills. Claim of Lien by Holmes Regional Medical Center

Send his a** to Williamson county Texas. You don't want to be caught in this county drinking-gray bar hotel time. Now just across the line in Travis county, where Austin is, that's a different story.

No. When someone is going about their daily business, not harming anyone, just going down the same old road as yesterday, and BAM! they get run over and killed, yeah it's worse. Maybe the fact that next could be you, me, or anyone we know makes it worse. But it is.

Well, I'll agree with you that the innocent suffer in both instances, Brian, but I still say that the wanton cruelty that people like Vick (allegedly) perpetrate on the innocent, even if those innocents don't happen to be human, is just a little more sick. And this same goes for children who have little say in this world also, of course.
If I would die today riding my M/C or driving my car or truck, I made the conscious decision beforehand to risk my life out there on the streets that I know contain a percentage of impaired people who shouldn't be out there on the same roads as me. This doesn't absolve them of their responsiblity to drive sober, but I know they're out there.
My two dogs rely on me to make decisions and to treat them well.
This may be more a case of apple/oranges though, but I didn't bring up this comparsion about the relative morality of these situations.

I agree with Dwight and I think the point is choice. Billy and the poor biker that got killed had a choice to go out and risk their lives on the road. Vics dogs and any dog in the "sport" (for lack of a better term) have no choice and are horribly treated and executed all inflicted upon them. Granted the biker wasn't killed because he wanted to be but he did have the choice to ride or not to ride the dogs had no such choice about fighting or being executed at a loss. I agree it sucks and Billy should have to pay but I feel Vic perpetrated a much uglier offence. He also lacks any common decency and should be treated as such but the sad truth is he will get off with what I consider a slap on the wrist compared to what should happen to him. They should lock him up just as if he was executing people since to me dogs are people too. I tend to like dogs much more than most people and fail to understand how anyone can be so cruel to an animal. I look in my dogs eyes and see nothing but an innocent beast that depends on me for everything and trusts me no matter what. I would never in a million years betray that trust.

At least Billy Lane was drunk so you can surmise he didn't cross the yellow line on purpose; Vick on the other hand did his dreadful work on purpose and with no remorse. To me that's a whole lot worse.
A positive attitude may not solve all your problems, but it will annoy enough people to make it worth the effort. Herm Albright (1876 - 1944)

Lane was stupid, irresposible and reckless. The result was the los of the most precious of life, that of a human. Whereas, with Vick and Co, the acts of premeditated crulety, the participation and promotion of violence against innocent and dependent beings, the use of them and their demise for profit and sick entertainment, simply the evilness of all of it is over the top and adds up to so much more than Lane's stupidity ( although all the dogs live's do not add up to close to the value of one human life ).

I wouldn't class him as a super star. Not even a great bike builder. Simply a run of the mill biker who got lucky and got on TV.
I wouldn't consider him a supstar anything either, and agree that he got lucky making him a media superstar. There are plenty of no talent people out there with superstar status and they all seem to get the sympathy to get away with almost anything.

Haell, this happened nearly one year ago. Is there any update on if justic was served. If I'm a betting man, I'm swinging towards....no. Google yielded no recent hits...

As far as bike building goes, Lane is a one trick pony. Jesse James is far more talented and seems to constantly reinvent himself and his style. And most other bike builders I've seen on TV, while not superstars, are far more talented than Lane. Being a professional dirtbag only works if you don't screw up. Beyond that all it does is sell bike parts and advertising for TV shows.
