Actually John, if it wasn't for the fact that this all took place in NY state instead of Illinois, I would've said it looks like "Gene" finally found a motorcycle for sale that somebody would take cash for, eh?!

Yeah... maybe Gene found a bike and rode it over to NY state.

Well, yeah Keith, I suppose THAT'S always a possibility too!
Though ya know, there ARE a whole lot o' "Genes" out there ridin', drivin' and even WALKIN' around with a chip on their shoulders.
(...yep, what a wonderful world this would be if more "Genes" out there wouldn't feel the need to pass THEIR genes onto a possible next generation, eh?!)

Yer right... there's too many bad genes being passed on by too many bad Genes, and in some cases wearing bad jeans. If we had a Genie to clean up the bad Genes there'd probably be an award.
Btw... glad the mini-van guy is okay!

Maybe we should hold a National...no, WORLD BA RALLY at Gene's? But, we don't tell him about it

We don't know the whole story but when you bring a gun to a fist fight, you generally get into a lot of trouble. You are required to retreat until it is not a viable solution before you can shoot him. Most folks don't keep trying to hit you when you have a gun pointed at them. I have always said that having a gun in many cases makes a reasonable person brave a few seconds too long. Without the gun they would have divorced themselves from the situation before it degraded. Disclaimer: I am a very strong 2nd amendment supporter. Cause I am sure somebody is poised over their keyboard to get into this one.

I don't think it was Gene
The bike was being tailgated by the car which led to a shouting match, and the biker tried to get a cops attention by beeping his horn.
When they stopped at a red light, the car passenger got out and punched the biker in the face, I think causing the biker, bike and girlfriend to fall into the road, possibly trapping the bikers leg under the bike. So, being trapped and his attacker being stood over him, he pulled out his legally registered gun and shot him, once.
Gene would have shot him a couple of times at least and also shot the car driver IMO
The pair in the car are claiming that the biker used racially offence language, which is an excuse often used by the guilty to pass the blame to the innocent, again IMO
BTW, the bit about the bike falling over and trapping the biker is just my interpretation based on what was said and that the bike was lying in the road
Which is why I agree with FJ about his aim being off

Yeah all this nation needs is a few more laws making it alright to carry a gun, we haven't got all the states yet , so we can have a real war! right here at home! and kill off a bunch of people like us ...just cause they have that enalienable right to carry a gun. The world is going madder by the day.Anybody see a pattern developing here. people are jus going to far.And the worst nuts, around are gettin their guns first so they can get ahead in the slaughter of honest folk like us,

Don't get me wrong Bob, I'm not pro-gun or anything, and I'm mightily glad that carrying guns is illegal over here, but if events did pan out how I suggested, it is one of the very rare occasions where I can see the pro-gun argument.
But only if my guess about the guy being trapped and still under threat is correct

So, if you are getting tailgated and words are being exchanged, why not pull over at the scene where the cop has a car stopped?
Getting back to being brave a little bit too long.

Yeah Bryn, Ron's right. I say let the COP shoot the asshat!
(well, I guess over there in Blighty, let the cop blow his little whistle at the asshat, anyway!!!)

You're right Ron, that would've been the best solution all round, which would have saved everyone a lot of grief, and would have possibly happened if the guy had left his gun at home

I am pro gun and I have license to carry concealed which I rarely actually do but you better have a ****** good reason to pull that trigger. If he was truly trapped and the guy was still coming at him I kinda understand. Or maybe you just take a whooping and move on. Thats the problem with the world now days, you get in a fight someone tries to kill you instead of just teaching ya a lesson(if they happen to be the better man that day).

Looks like the "hole" story is almost a half inch (0.45"). In the front anyway, probably larger in the back.

Well, in this case one guy has been ventilated so may watch his manners next time and another won't be shooting anybody again for a few years. A good ending for participants I would say

I think he should plead self defense based on how most minivans are driven.

I don’t have any numbers, just a California public safety guys word, to base this on. Back in the late 1980‘s there was a rash of shootings on the Los Angelus freeways. Actually not many shootings and very few victims but a LOT of press coverage. This guy was a Naval Reservist and told me at the time that the number of fatalities was way down as jerk drivers were being more considerate out of fear of being shot but that the authorities didn’t want to publicize the fact. True or not? I really don’t know, but it sounds reasonable. An armed society is a polite society.
We all like to think of ourselves as rugged individualists. But when push comes to shove most of us are sheep who do what we are told. Worst of all, a lot of us become unpaid agents of whoever is controlling the agenda by enforcing the current dogma on the few rugged individualists who actually exist.

Seems a clear case of self defense, especially if the bike fell over trapping his leg, although I didn't see that in the news story.

You can use your gun in Ark. when you really fear for your life or your family life. Sounds like he feared for his life. And I'm tired of giveing a helping hand to anyone for 40 years that can't help them self. I don't care what race. And another think the " N" word is offecive to me I want whom every use it punished to the full extent of the law, what every race they or.Rudy

The only thing we know for sure is this. A guy with a gun shot a guy without a gun. The guy with a gun for some unknown reason saw a police car but did not pull up behind the car for safety. That same guy is in the jailhouse. He is in the jail because they interviewed witnesses. Did you note in the report the bullet went through the other guy? If that bullet that went through would happen to kill one of my family members, jail is a very safe place for that moron. By a freak accident a totally innocent person did not die from his actions. I don't like that word either. Can't imagine he would would say something off color in a road rage back and forth discussion Two marginals in a rolling argument and innocent citizens were placed at risk of death or serious physical injury from it. I have some real problems with that shooter. For some reason so do the police.

Actually from the article I read we know a little more. 1. The guy was tailgating the motorcycle. 2. When the motorcycle stopped at a red light the passenger of the minivan got out, went over to the motorcyclist and punched him in the face. That was from an witness not from the motorcyclist. Also the motorcyclist, in the picture release by the police, has a nice black eye.
Someone said the bike fell trapping the motorcyclist. If that is true and the passenger continued the attack then as I said, self defense.

There is 0 information that the bike fell on the guy and he was trapped as the other guy continued to attack.
If that had occurred he would be charged too.

Here is another very informative article. It includes statements from a witness, the girlfriend of the biker as well as the driver of the van. link

Well looking at the statement from a witness(a security gaurd), who is on completely neutral ground as an observer with no interest in the parties involved, the motorcyclist seems to have acted in self defense. There are links to the statements at the bottom of the article.

Some moron looking for trouble got shot. I think it's funny. There's a lesson here, I'm always polite in traffic and refuse to engage with anyone who desires otherwise. That said, if someone gets out of their car and hits me while I'm on my bike, they'd better finish the job. Still laughing at Michael Lee. I hope the bullet hit him right where his balls would have been if he had any. Darwin at work.

I confess it was me who said the bike fell over and trapped the shooter, but I did try to make it clear that it was just speculation on my part, and I did put this disclaimer at the end Quote:
BTW, the bit about the bike falling over and trapping the biker is just my interpretation based on what was said and that the bike was lying in the road
All I was trying to do was give my reasons for not thinking it was the "Gene" from another thread
None of which answers Saxtrons question of why didn't the guy pull over by the cop?
