I need to ask you something and I want you to be totally honest with me. It might be awkward between us after this but I have to know how you feel. I have kept it in for a while now but I think its finally time I be straight up and just confront every body with it. I hope this doesn’t ruin the relationship we already have. I just need to know and I don’t see any other way I could get over this. Just doesn’t seem fair on me if I don’t get an answer. I want you to tell me truthfully, no matter how harsh it is. I just want your honest opinion……. Would you say a Jaffa cake is a biscuit?

Depends on your definition of a biscuit. I think what we call a biscuit in the US is not what others do in other countries. I , with what I consider a biscuit, would not.

Depends on whether you're using Oxford or American English.
I would define a Jaffa Cake as a wonderfully delicious mass produced confectionary snack cake containing nothing but the finest artificial ingredients and having absolutely no discernable nutritional value. But, I suppose you COULD call it a biscuit...

What I'm lead to believe is that they are not subject to the VAT in the UK and therefore are a cake. Sleep well!

The Jaffa Cake is neither cake, biscuit, wafer, or cookie. The Jaffa Cake is a fibrous amalgamation of processed grains and what may be cardboard (speculation), artificially flavored with one or more chemically produced additives and in some cases, mutated fruit particles, the resulting polymerized blend is then covered with a plasticized brown coating. This coating is advertised as chocolate, however, it is in reality a waterproofing and sealant used to maintain the appropriate moisture content of the inner material. Although not regarded as an edible food source in most cultures, they understandably are quite popular amongst Brits.(Primarily the English), as most English find food stuffs such as kidney stew, mutton, and even spotted dick a treat. Having eaten a sample or two, my recommendation is to stay clear of them. If they were food at all, the Two Fat Ladies would have featured them on a show.

I would say most definetly a biscuit.
Ask anyone working for minimum wage at Tesco "where are the Jaffa cakes?" They will direct you to the biscuit aisle.
If they were cakes or you got a "special" store assistant then they would direct you to the bakery aisle where all the cakes generally occur.
Steer clear of store own brands there is only one true jaffa cake and that is made by Mcvities. Sleep safe!

ok the official line is it is a cake........ "These small circular sponges topped with chocolate and squidgy orange stuff have been the subject of much debate over the years. Even the British government has become embroiled in this web of snack-related intrigue. At present the Jaffa Cake is classified as a cake but the British government is attempting to get it reclassified as a biscuit. This would mean it would come under a higher tax bracket as biscuits aren't as perishable as cakes, or something technical like that." Quote taken from the BBC

and another one: Jaffa Cakes are designated cake produce by Her Majesty's Customs and Excise. There have been murmurings of a serious cake vs. biscuit dispute in the Houses of Parliament involving VAT arguments, biscuit moisture versus cake moisture ratios... According to the crumbtastic A nice cup of tea and a sit down website, Jaffa cakes are indeed cakes, "Yes the VAT man wanted it to be a biscuit. That way it would fall by virtue of its chocolate coat into a category of products liable to VAT at the standard rate, i.e. luxury biscuits. As a cake however it is zero rated for VAT, no matter how luxuriant, much to the VAT man's continuing annoyance." So that should put an end to it, so sleep well my friend!

Think I need to go get myself a life... wonder what aisle that would be at Tesco? Oh well all's well that ends well.......... Sun is shinning for once! So off out for a ride

It has been legally proved in court that the Jaffa Cake really is a cake. McVities opened a packet of Jaffa Cakes and a packet of biscuits (maybe Hobnobs, the report didn't say whether they were the chocolate covered kind) and remanded them into the custody of the bailiff. When court convened a week later, the Jaffa cakes had gotten hard, proving they are actually cakes while, the biscuits (as they usually do when stale) got soft. I have to commend the bailiff for his great moral strength and sense of duty for not eating the Jaffa Cakes straightaway.

I'm familure with Little Debbie cakes, but I tried something at a party that was imported, labeled chololate covered biscuits, a while back and thought they were fantastic. I went nuts looking for them for about six months to no avail. They were soft cookies (short bread I think) with milk chocolate on one side.
The closest thing I've found since is Girl Scout cookies called Thanks a lots.

Here is your answer, from the court system no less.
Under UK law, no Value Added Tax (VAT) is charged on biscuits and cakes — they are "zero rated". Chocolate covered biscuits, however, are subject to VAT, currently 15%. McVities classed its Jaffa Cakes as cakes, but in 1991, this was challenged by Her Majesty's Customs and Excise and the case ended up before the courts. This may have been because Jaffa Cakes are about the same size and shape as some types of biscuit, and particularly because they are commonly eaten alongside, or instead of, traditional biscuits. A question that the court asked itself was "what criteria should be used to class something as a cake?"
McVities defended its classification of Jaffa Cakes as cakes, producing a 12" (30 cm) Jaffa Cake to illustrate that its Jaffa Cakes were simply miniature cakes.
McVities argued that a distinction between cakes and biscuits is, among other things, that biscuits would normally be expected to go soft when stale, whereas cakes would normally be expected to go hard. It was demonstrated to the Tribunal that Jaffa Cakes become hard when stale. Other factors taken into account by the Chairman, Potter QC, included the name, ingredients, texture, size, packaging, marketing, presentation, appeal to children, and manufacturing process. Potter ruled that the Jaffa Cake is a cake. McVities therefore won the case and VAT is not paid on Jaffa Cakes.

My first job when I left school was at a company called Hugh Stevensons that made cardboard cartons. The factory was next door to McVities and the smell of them Jaffa cakes was fantastic. Who cares, cake, biscuit, just the taste is all you want.
