Here's a question for everyone....." The helmet has full European ECE R22-05 approval." But is not DOT approved for the US or Canada. You wear one here....you crash....you have an injury and try to collect on your insurance policy.....Does the insurance company have a way OUT of NOT paying you?

What is the helmet requirement in Canada? does the law specify DOT? or Snell? or just that you wear one?

That might be a good question for your insurance carrier. Helmets aren't even required where I live. Only for bicycles.

The insurance is a good question. I bought a Davida about 5 years ago, and at the time did a bit of searching comparng the DOT & European standards. The best I could tell the ECE R22-05 rating system was more rigorous than DOT and therefore a better helmet?? Why they didn't also carry the DOT sticker seemed odd. Davida now has helmets that carry both stickers.
None of which answers you original question.

No they don't have a way out.
Unless you would have some strange language in your coverage that excludes payment which I doubt.

I'm not an attorney or an insurance professional but I'd guess any insurance coverage would have exclusions if the insured motor vehicle doesn't satisfy state motor vehicle regulations. If a DOT helmet is required in your state, I'd also guess that similarly applies.
I pick up free copies of "PA Biker", etc avaialble from bike shops (make good on the road dinner reads). One has a monthly article by an attorney. A few months ago, he described a scenario where an insurance carrier didn't want to cover med bills because the helmet worn by the insured wasn't legal. He fought and eventually won, but it took an attorney. (believe this was a NY case)
Be interesting to hear from someone in the industry on this. (although I now wear a DOT/SNELL 1/2 helmet 90% of the time)

In Ontario, Canada, helmets must be worn and must be DOT Certified as I understand it.

I don't doubt what you're saying, but Just a random thought - how can Canada legally adopt a US agency (US DOT) rule / certification?
... not that it matters too much

Isn't Canada the 51st State?
This was taken from the Canadian Highway Traffic Act....
2. The helmet referred to in section 1 shall conform to the requirements of the,
(a) Canadian Standards Association Standard D230 Safety Helmets for Motorcycle Riders and shall bear the monogram of the Canadian Standards Association Testing Laboratories;
(b) Snell Memorial Foundation and shall have affixed thereto the certificate of the Snell Memorial Foundation;
(c) British Standards Institute and shall have affixed thereto the certificate of the British Standards Institute; or
(d) United States of America Federal Motor Vehicle Safety Standard 218 and shall bear the symbol DOT constituting the manufacturer's certification of compliance with the standard. R.R.O. 1990, Reg. 610, s. 2.

Well since the government does have a certain requirement, I guess if you wear a "lesser" helmet, your insurance company could stick it to you.
What is the difference between the British standards institute and European ECE R22-05 ??

I can't answer that. Maybe some one from across the pond can jump in here.
