Croft motor racing circuit loses noise appeal
A RACING circuit today lost its appeal against a legal case brought by a couple and their daughter who say their lives have been blighted by noise from the track. Croft Circuit, near Darlington, was also hit with an injunction, restricting "noisy activities" at the track to just 40 days-a-year. Derek and Julia Watson and their daughter, Jill Wilson, all live within about 300 metres of the circuit, in Dalton-on-Tees, and say their enjoyment of their homes has for years been gravely affected by the "loud, intrusive and repetitive noise". In an extremely rare decision in April last year, High Court judge, Mr Justice Simon, ruled all three had been victims of "noise nuisance" and ordered the circuit's tenants - Croft Promo-Sport Ltd - to pay Mr and Mrs Watson £109,600 damages, and Mrs Wilson £40,000. Croft Promo-Sport had its appeal against that order dismissed by judges today. However the issuing of the injunction will result in a reduction in the residents' damages payouts, which were largely based on the reduction in value of their homes caused by the noise nuisance. Croft Promo Sport also faces massive legal costs bills. The Watsons and Mrs Wilson were represented by top QC, David Hart, and their legal costs bills alone have been put at around £700,000. At London's Appeal Court, Croft Promo-Sport had argued that Mr Justice Simon was "plainly wrong" to rule in favour of the Watsons. Richard Jones QC, for the company, argued that 1963 and 1988 planning permissions granted for the race track - formerly a World War 2 aerodrome and first used for racing in 1949 - had "changed the character" of the area to such an extent that the noise levels were reasonable. He added that noise and other issues relating to the racetrack had been carefully considered by expert planning inspectors during two public inquiries and a balance struck between the interests of local residents and the public amenity value of the circuit. The QC said the court decision would have serious implications for the future use of the racetrack and had left Croft Promo-Sport not only exposed to enormous legal costs bills, but also open to other potential claims by an "uncertain number" of other neighbouring landowners. However, Appeal Court judge, Sir Andrew Morritt, today said he could find no legal flaw in Mr Justice Simon's conclusion that the Watsons and Mrs Wilson had suffered an "actionable nuisance". Sir Andrew, sitting with Lord Justice Richards and Lady Justice Hallett, also ruled it was "illogical" of Mr Justice Simon to deny the trio an injunction, restricting the number of days to 40 on which "noisy activities" can take place at the racetrack. Croft Promo-Sport were refused permission to appeal further to the House of Lords and ordered to pay more than £120,000 in legal costs straight away. That will be only a fraction of the total lawyers' bills faced by the company. The objection by the Watsons and Mrs Wilson was not to car and motorbike racing events, which take place on the track on about 45-50 days-a-year, but to "vehicle testing days" and "track days", when members of the public drive cars around the track all day long at high speed.

I feel that I could not alter the report; where the future of racing in Britain may have been at the mercy of the “Boom-Bustâ€economy, the insurers and the ACU, it now appears it is at the mercy of nearby residents, the Courts and their conclusions.

Apart from making the link to the petition clickable that is exactly how it is of that website, which in turn the CEO has cut from a news site.
My worry is now that once one of these cases has gone through, more will and it will cause circuits to close. I know that the people of Donongton have hated the track there for years... and I dread them getting wind of this.
I suspect it'll only let people in the UK sign the petition, for those in the UK PLEASE DO.

That's like people that live by airports! In Chicago, people were getting free windows and central air if the lived within a certain radius of midway or ohare. You live next to an airport, deal with it!
We might loose a local racetrack because of noise complaints. The track has been there forever, but a bunch of whiny transplants in their new, high dollar subdivisions don't like the noise. Waaaa! The track was here first. Forget about the money the racers bring to the area every weekend spring thru fall. It won't be the first track we've lost in the chicagoland area due to "development".

I live within 4 miles of Croft race circuit and signed up to the petition via Darlington Central Motorcycle club some months back..even before the injunction was announced. It will be a sad time IF yet another motorsport venue in this area goes the journey. Here is a list of some of the events I would attend as a moped riding youth.... and are no longer with us. Teesside Speedway circuit, Redcar beach motorcycle sand-racing, Aycliffe stock car race track.
Some of you may have heard of Russ Swift and his son Paul Swift, Renowned for car stunt driving etc...well if it weren't for Croft, then Russ and Paul wouldn't have had any where to perfect their art. Local lads you see.
Think what you say .....before you say what you think!!! If in doubt...say nowt!!

Maybe give deaf people a tax break if they live in high-noise environments.(thanks Gallagher)

I agree fully, but I do feel for the people who live somewhere then a company comes in a builds a track next to them with out giving them a choice, happened many times around here.

Been happening here for years now , the scum from NYC move here and want all the locals to change their ways to suit them and first thing they do when they move to the woods is cut all the trees down!

Reminds me of a local story, but one that resembles many in the new "country estate" areas. The local auto salvage dealer moved from just inside city limits,(complaints), to 4 miles out, on a gravel road, in the country, at least a mile from anyone else. He was there about 12 years. Then, somebody buys the property just across his fence, and builds a new home. About a month after the new owner moves in, the salvage yard owner was mowing his grass, along the fence, and the new neighbor walks over from his new drive. After about ten minutes of conversing about local news, the new home owner casually says, " Hey, when are ya gonna get rid of all them old cars?" The salvage yard owner patiently explained that this was his business and livelyhood, if he didn't want to live next to a salvage yard he shouldn't have built there, and to stuff it! True story.

Yes, that isn't to sat all from NYC are scum but seems the ones that moved here are for the most part. Parents trying to get kids away from the gangs bringing the gangs with them. Throw litter all over, graffiti, huge rise in crime, etc.. Mostly welfare types not to mention what it has done to our school taxes.
