I bid on a Paul Smith Triumph wallet, stunning thing, was just the right time as my Shaun the Sheep one has broken. Got it for £22 + postage - absolute bargain. Went to paypal paid for it and thought some Monday, I'd have a new wallet. Saturday morning, get up turn computer on, loking here and check email. Got a REFUND from paypal and a message. Quote:
i'm sorry but i am not selling this item for as little as £22 - it cost over 4 times that amount. i will refund your money in the next 24hrs! sorry but i'm sure you understand.
I replied
Quote:
You can not do this. You should have set a reserve if you wanted to sell it for more. I will go as far as £50 INCLUDING POSTAGE, but no more.I would have probably gone that far if anyone else had bid. If this is not acceptable to you I will be forced to report you to eBay and leave -ve feedback. This is from eBay's help section...
What buyers can do if they feel a seller has breached the Seller Non-Performance policy
If a seller has refused to complete a sale, and payment has not been sent or payment has been refunded, report the seller. Make sure you include a copy of the email documenting the seller's refusal to complete the sale with the full message text and complete email headers when making your report. I'm trying to compromise. I'm not into reporting for no reason, and even though I have a reason I'm trying not to.
Today I got:
Quote:
ve only just picked up your email this morning and will think about this; perhaps i should've put a starting price in but i thought it'd sell easily as PS stuff always does. either way, £22 or £50 i lose - will come back to you.
I'm not really sure what to do next. I still haven't got to reporting him (I know I'm being far too reasonable) - YET. At the end of it, I would really like that wallet, and I need a new one anyway, but I'm really pi$$ed that he's gone against eBay policy. And they don't come up for sale that often.
Thoughts guys...

You should get the wallet for £22 and not a penny more. So sorry for his stupidity but that's the way it works.
However, there's a good chance you will not get it and he will just eat the bad feedback. Complaining to eBay or Paypal will get you virtually nothing but you will still have to do it to be on record...

His feedback is 98.6% postive. But he's only sold 5 things (that's more than me - I'm a hoarder). And they were all over a year ago. I know that if I report him I'll get nothing at all, possibly knock my rating and just cause trouble - that's partly why I'm being reasonable. Out of work I'm not really a troublemaker...
one good thing is he hasn't relisted it.

It's his mistake and he should give you the wallet for what you bid on it. It doesn't look like he'll be giving it to you so you might as well give him the negative feedback.

Definitely file a complaint with eBay. If he had a minimum price in mind, then he should have set a reserve price. That would have given him the option to not sell it, otherwise he is obliated to sell it fro whatever the highest bid is.

I agree, they have a reserve price for a reason. If the seller isn't smart enough to set a reserve that's his fault. I'd contact ebay about that, they might be able to do something about it.

Stick to your guns too Gina. If he comes back with 'how about £60?' tell him no, you want it for the auction price. I know you will but be on the lookout for a re-listing. Huge violation which would ban him.
98.6% on 5 listings??? Sounds like he is trouble.... Good luck Gina but I am betting this is not going to turn out good for you.

Where was he? Say you'll pay £75 cash but only if you can collect (not trusting post etc) and get his address ... accidents happen, know what I mean? Screw him, report him to e-bay and give -ve feedback. Like Phil says, such a low rating with only 5 items suggests he's as bent as a 9 bob watch and you might not get the thing anyway. If he's been hit by a stoopid stick and didn't start the bid near to what he wanted, that's his tough sh!t. He's a friggin' moron. This cretin obviously missed his market - if PS goes for much more, why didn't this? Did I mention he was stoopid? Just to prove there are some honest e-bayers .. I won a bike last week and collected it yesterday. The guy said the price was wrong ... I immediately thought "here we go!" "you bid too much, it's not worth that much!" I it got for less than half my winning bid!!!! WTF???

Stoopid ain't the word I guess. His feedback is 71, but only 5 are for him selling. An I kind of has his address. It doesn't have a street name, but where he lives....it can't be that big. I do have a post code.....

Report him. You have already sent your dinner order back to the kitchen so-to-say. No telling what he'll send if you renegotiate. Would you really ever trust what he will say or do?

Report him. eBay's credibility is built on the premise that auctions are final and sellers honor their commitments.

If you attempt to make a deal outside of ebay, you have no protection. Report him to ebay/paypal. If he doesn't pull his head outta his sphincter in a couple days, give him neg feedback and move on.

Good luck with ebay they're huge and definately have no time for you. Furthermore, leaving negative feedback will cause the seller to return in kind. In the long run good experiences will hopefully outweigh bad experiences but you have no real recourse. I've had people cash my check and never send my item (luckily nothing terribly expensive). After 30 days you can't even leave feedback. If you truly want this item, try to work with the seller. P.S. Hope it isn't a knock off.

At the risk of getting jumped on, I'm on the sellers side. Just step back a sec. and think about the real world transaction. You wouldn't normally expect him tosell something to a stranger for way less that its value. eBay doesn't change that. It just gives us a forum for complaining. I have sold lots of stuff on ebay - mostly my own odds and sods - not bought for the purpose. Selling for under my cost is the normal situation. If I committed the error this guy did - no reserve, didn't cancel the auction when it wasn't working out, I THINK I might feel obligated to go through with it but I dunno - converted to C$ it would be a lot to lose. Very handsome looking things by the way - I want one too!

No jumping Bill but he entered into an agreement when he set up the auction. Sucks that he didn't read the rules but he should honor the auction and learn from his mistake.

Sorry Bill, but I have to disagree with you. He made a mistake and should have to live with it. That's the risk you take with ebay and setting a low opening bid or not setting a reserve. I doubt it's the most costly mistake he ever made....

I can't agree with you Bill. He set the starting price. Because it didn't go as high as he expected isn't the problem of the buyer. He should have set a reserve price or just started at a price where he was comfortable letting it go at. I've sold a few things where I thought they would get more but I always shipped them off. That is how ebay works. He owes Gina the item she won.

The same thing happend to my friend on a 52 Chev coupe he was trying to buy. The guy had it listed under parts and had no reserve. He told my friend he thought he would get more hits and realized he posted it in the wrong place. I think he was banned from e-bay because of this. Its a breach of contract. Rules are rules, and the dude should abide by his agreement regardless. Even if he losses his A$$ on the deal.

Don't offer him any more, G; get onto ebay and see what they say. The bloke's actually admitted that it he knew about reserve prices so it's a gamble he took...and lost. As I don't think ebay will help and I also don't think he's going to give it to you as a gesture of goodwill, another option is to take it to a small claims court. Perhaps just the threat of court action will make him think again-know any friendly solicitors who can fire off a short letter to him??!! Depends how much you want it.

You know, aside from just leaving the man negative feedback its awesome to have a website like this that gets the word around. If he didn't have the foresight to set a reserve price, then he should eat the loss and give you the wallet. Beyond that its cool to see that if he's not going to honor his contract, then at least the laundry's getting aired out here. I don't know about you, but I wouldn't buy from this guy unless he decides to honor his word, and eats the loss.

Not that one...this one
And if I went to a shop and something had the wrong price label on, like it was priced up at £10 and it should be £15 I'd get it at £10. That's the law here. We have lots of programmes on TV in the morning where they sell stuff at auction after they've bought it at an antiwques fair...if the things make a profit great, they keep it. If they don't, they don't. More often than not they don't. The fact he was a little assuming that it would go for more is his problem I guess. If he bought it to sell at a profit 6 months later....he should have put a reserve on.
I'm gonna post to him and give him till 6pm (BST) tomorrow to make a decision either way. If nothing by then....I'll already have drafted my email to eBay.

You've already given him more than enough time to do what's right. Obviously that won't happen. He made the mistake and as such should have honored your winning bid from day one. Make the report, and tell everyone you know about it.

When I sell on EBay I set my opening bid at $1 and take whatever the item brings. That's how an AUCTION works!
He deserves the negative feedback and you should give it to him. I have ben on EBay for ten years and have a 100% positive feedback. And yes, I have given negative feedback before.
The guy is a dick and needs to be flamed.
He came up and asked, "What are you riding?" I looked at him and said, "Triumph Bonneville America" and he got that 'hellz yeah' look in his eye.

Gina,
The seller entered into a contract with e-bay and the potential bidders. He is bound to honor those terms and cannot back out if it doesn't turn out how they wanted, as others here have pointed out. The only thing I can suggest is to hold off on leaving negative feedback. Report them to e-bay as a dead-beat seller and let e-bay contact them. Usually, e-bay can 'persuade' them to reconsider their actions and uphold their end of the deal. Leaving negative feedback will most likely get you negative feedback as well. If it were me, I'd report them and see what happens. If you still don't get the item, let it go.. don't leave any feedback and move on.. unless you don't mind the possibility of getting a retaliatory negative.
Cheers, Brad

I sent him a "sendmearequestfor£50" message....hopefully I should still get the wallet in a couple of days... Once I get it I'm not gonna leave feedback till he has. Then if he leaves me +ve I'll leave neutral or maybe +ve. If he gives -ve.....he'll get reported and see what the consequences are.

I think you are being way to generous! Reporting him to e-bay should be your first step.. the only consequence is that e-bay will send them a message reminding them that they are required to honor the auction terms, and will keep a record of his non-compliance. If he tries to pull the same thing repeatedly (like 5 times IIRC), they will boot him off e-bay. Usually, just the message from e-bay directly will cause them to change their mind. Good luck either way Cheers, Brad

ok so, bizarrely, exactly the same thing happened to me yesterday. I had been tracking some saddlebags where bidding was light and I thought I might get a bargain. They weren't exactly what I wanted but I figured if I could get them for $100'ish what the heck. The buyer had a $300 "buy it now" which seemed silly so I ignored it. At the last minute I put in a bid of like $101 and won the bags for $86. A couple of minutes after the auction closed I got an email from the seller saying that the auction hadn't reached his reserve price of $250 and that he wasn't going to sell something that he could return for a restocking fee. I pointed out that he might have WANTED a $250 reserve price but he didn`t have one or it wouldn`t have sold for $86. In the end though I think the sale needs to get cancelled - there`s no joy in making people unhappy - even fools. Now, if it had been a triumph wallet I might feel differently. BTW, like Gina`s clown, the guy`s feedback was almost all as a buyer - probably the first sale he had tried. sold item

Another one??? What the he!! happened to integrity?
Bill, just like Gina, I would tell this jerk to honor the auction AT HIS LOSS. Maybe he will learn a lesson about selling on eBay. Sorry, I have no sympathy for people who do not read the rules and/or overlook the simple stuff. If you have ever sold anything on eBay, there is a process you go though (unless you use TurboLister, Ebay's free offline auction editor) and it's VERY hard to miss the Buy It Now entry.....
I would most assuredly report him to eBay though, regardless of auction outcome. Take screenshots of the auction, keep all you email, and report the arsehole.
