I was entertaining the idea of a group,20 or so,convening at a church and riding approx. 50 miles to a restaurant and do some shopping and return.Would I need to get a waiver of liability form for riders to protect myself and the church ?It would not be a fundraiser and no funds would be collected for dinner,ect.If any one has any experience or insight,I would be grateful. It depends on if you are going to call it an actual sponsored ride, or if you are going to call it a bunch of people that are going on a ride together.

Uh,I think I may just call it a bunch of people riding together and downplay it somewhat,i.e. don't advertise it,etc.

I would C.Y.A.. I read some amazing claims for huge sums of money. Eg a drycleaner lost some pants $$$$$$$$$. Better safe than in debt for 5 big ones.

we live in a litigious society....it seems small or petty but it is necessary...have one signed and just put it on file...make it simple and sweet...the lawyers are hungry !

waiver...give me a break. the first time i have to sign a waiver before a ride is the last time i ride with any of those tools

Waivers are not worth the paper they are written on. One cannot sign away their right to redress. (Others will argue this, but distill it down and the bottom line is as stated) If you need waivers, you need to not ride with those folks.

Like Moe said, I've heard (University lawyers) say you can't sign away your rights for redress, or red dress. Having said that, we use them for some youth (not yute) activities.

I would think there's a big difference between you as an individual loosely organizing a ride and a "sponsored event", like say a dealership.

I am conflicted about this. As a commerical insurance agent, I always require my customers who set up special events (i.e. a bike shop that does weekend rides) to have a waiver, (which I can send you if you like) But this dosen't mean that they can't sue anyway. Even if you are innocent, you still have to pay to defend yourself, which can be one of the biggest expenses. Do people sign waivers @ the rallies? If not, then I wouldn't worry about it.

That turned out longer than I expected.


I go to parties, sometimes untill 4. It's hard to leave when you can't find the door.

People sometimes sign waivers at rallies, but only if they are sponsored rides. I have never signed a waiver when it is a bunch of us just going for a ride, even when it's been planned for a while.

There are a bunch of us at work that are planning a long ride at the end of the month. But, it is just a bunch of us just going for a ride, not sponsored or endorsed by work or anyone, so no waivers or anything.

Waivers don't do anything anyway.

The way around waivers is to meet up in a public parking lot before the ride starts. If you start from a specific spot (a church lot) then the law "assumes" it is the church that is sponsoring the ride and are thereby legally responsible since they are the originators.
That's the way it is here in NY at least.
Becky, a real lawyer (I just play one on TV) might be able to clarify this a bit.

At the MSF course i teach before the course starts every student has to sign a waiver. Basically, if they fall over and break some thing its not our thought, and that they take the course at their own risk.

One of the high ups in the MSF told me that the waivers are not worth a thing. If they want to sue us they can, thats the world we live in.

Tell your riding buds you are going for a ride and if anyone wants to join they can.

I wonder, if we were to wreck on the bike, could we we could sue Triumph. Heres my argument. If triumph had not built such an attractive motorcycle I would have not been lured into buying the bike, and so, would not have been involved in the wreck. Think a lawyer fight that fight.

There is a difference between teaching a class a going for a ride.
